Terms of Service

Welcome to ArcoMage. These Terms of Service ("Terms") govern your use of arcomage.org, the ArcoMage game client, our forum (forum.arcomage.org), spell database, leaderboard, online store, and any other website, app, or service operated by ArcoMage (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Who We Are
"ArcoMage," "we," "us," or "our" refers to ArcoMage, an independent game studio operating the Services. You can reach us by mail or email at the addresses listed under Contact below.
2. Eligibility
You must be at least 13 years old to create an account. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Services with the consent of a parent or legal guardian. The Services are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. See Privacy Policy for our COPPA practices.
3. Accounts
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, abuse the Services, or harm other users.
4. Acceptable Use
You agree not to: (a) cheat, exploit, or use unauthorized third-party software against the game or matchmaking systems; (b) harass, threaten, or impersonate others on the forum, in-game chat, or any community space; (c) post content that is unlawful, hateful, sexually explicit involving minors, infringing, or that doxes another person; (d) attempt to probe, scan, or breach the security of the Services; (e) scrape, mirror, or re-host substantial portions of the Services without written permission; (f) use the Services to send spam, phishing, or malware.
5. User-Generated Content (Forum, Chat, Profiles)
You retain ownership of content you post (forum threads, chat messages, profile text, custom decks). By posting, you grant ArcoMage a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as needed to operate and promote the Services. We may remove content that violates these Terms or applicable law. We do not pre-screen user content and are not responsible for it.
6. Kickstarter, Pre-Orders, and the Store
Purchases made through Kickstarter are governed by Kickstarter's own terms. Purchases made through arcomage.org/store are processed by third-party payment processors (currently Stripe); your payment-card data is handled by the processor under their terms and is never stored on our servers. Physical reward fulfillment timelines are estimates, not promises; we will notify backers of material delays through the Kickstarter update system and our email list.
7. Virtual Items, Founder Chests, and Game Economy
Cosmetic items, founder portraits, spell unlocks, and other in-game rewards have no real-world monetary value and cannot be exchanged for cash, transferred between accounts, or sold to third parties. "Founder Spell Chests" and similar reward bundles are deterministic bundles, not loot boxes; the exact contents of every chest are disclosed on the Kickstarter reward page and the Store.
8. Text Messaging (SMS) Program
ArcoMage may operate an opt-in SMS program for Kickstarter backer updates, tournament announcements, account security notifications, and related project news.
8.1 Consent & Opt-In
You only receive SMS messages from ArcoMage after you affirmatively opt in by (a) checking an SMS opt-in box during signup, Kickstarter pledge, or account-settings update; or (b) texting a keyword such as JOIN to our short code or long-code number. Your consent is not a condition of any purchase. We retain a record of when, how, and for what purpose you opted in.
8.2 Message Types & Frequency
Message frequency varies. You may receive transactional messages (account, order, and security notifications) and, if you separately opt in, promotional messages (campaign updates, tournament invites, store announcements). Typical promotional frequency is no more than 4 messages per month.
8.3 Message & Data Rates
Msg & data rates may apply. Your wireless carrier may charge you for sending and receiving text messages. ArcoMage is not responsible for carrier charges.
8.4 HELP and STOP Keywords
For help at any time, reply HELP to any ArcoMage message, email legal@arcomage.org, or call (833) 319-3160.
To opt out at any time, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any ArcoMage message. You will receive a single confirmation message and no further marketing messages from that program. You may continue to receive transactional messages where required by law (for example, a one-time password you requested).
8.5 No Sale or Sharing of Opt-In Data
ArcoMage does not sell, rent, lease, share, or otherwise disclose your SMS opt-in information (your phone number and the fact that you consented to receive text messages) to any third party for marketing or promotional purposes. SMS opt-in data is shared only with our messaging service provider (currently Twilio) as needed to deliver the messages you requested. See Privacy Policy for full data handling.
8.6 Supported Carriers
The SMS program is available on most major U.S. carriers, including AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost, MetroPCS, Cricket, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.
9. Email Communications (CAN-SPAM)
If you subscribe to our email list, every marketing email includes a one-click unsubscribe link and our physical mailing address. You can also unsubscribe at any time by emailing legal@arcomage.org. Transactional emails (account, order, password) will continue regardless of marketing preferences.
10. Intellectual Property
The ArcoMage name, logo, game art, card art, spell text, audio, and underlying software are owned by ArcoMage and protected by copyright, trademark, and other laws. Except for content you create, you may not copy, modify, or redistribute the Services without written permission. Fair-use commentary, streaming, and Let's Play content are encouraged and do not require permission.
11. Third-Party Services
The Services integrate with third parties including Google (sign-in/OAuth), Discord (community linking), Kickstarter (pledges), Stripe (payments), Twilio (SMS), and our analytics provider. Your use of those services is governed by their own terms and privacy policies.
12. Disclaimers
The Services are provided "as is" and "as available." To the maximum extent permitted by law, ArcoMage disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, secure, or error-free operation.
13. Limitation of Liability
To the maximum extent permitted by law, ArcoMage's aggregate liability for any claim arising from the Services is limited to the greater of (a) the amount you paid ArcoMage in the 12 months before the claim, or (b) USD $100. We are not liable for indirect, incidental, consequential, or punitive damages.
14. Indemnification
You agree to defend and indemnify ArcoMage against claims arising from your violation of these Terms, your user content, or your misuse of the Services.
15. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms. You may stop using the Services at any time by deleting your account (request via legal@arcomage.org). Sections 4, 5, 7, 10, 12, 13, and 14 survive termination.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced on this page (with a new effective date) and, for users with accounts, by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
17. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-laws rules. Disputes will be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania.
